Brother needs to understand that receiving any inheritance is a privilege not a right.

It’s not about what she wants. It’s about her dad’s wishes. And she should honor that.

a will rewritten when someone isn't fully compus mentis isn't valid, so the small victory would be easily challenged

Yeah, that's not gonna fly. The will is not only invalid, but the solicitor and author are now co-conspirators engaged in elder abuse and fraud.

If she deliberately mislead her dad, for her own selfish (childish) reasons, then that's not fair, I understand the want to cause pain to her brother but not at the expense of the bond of trust between dad and daughter!

yes the AH. I get the frustration and anger at brother not helping with your dad or gloating about his inheritance when dad is still alive, but it's not up to you how the dad decides to spend HIS money.

I have been down the road of entitlement by death so I know how ugly it gets she is not abusing the father she is basically taking responsibility because of her loyalty to her father

This is a well-written story, and the question is moral, not a legal aspect of the will. Was she right or wrong?

I find it wrong morally. Neither the sister nor the brother should feel entitled to deciding about the heritage of their parents. Only the parents can decide about that. I understand the resentment about being solely left in charge as a caregiver for a dement parent, while the other sibling is living a carefree life, but this should not be mixed up with the heritage. And while I understand that being a caregiver can be financially draining as well and takes a lot of time and energy, as adults we should be responsible for our own decisions, even if they affect us negatively. In that sense I would actually recommend to have a facts based dialogue with the sibling, explaining the variety of costs on so many levels and trying to find a solution

I would at least give him a little. Maybe that will help when he tries to contest the will. Unless he is super broke now, I would give him less so he can’t pay someone to contest it.

Although your brother may be wrong bragging about what he will get. If you respect your parents then you are in the wrong. I agree with your husband. Two wrongs don’t make a right!
