The Supreme Court heard oral arguments yesterday about a challenge to Humphrey's executor. The actual case is called Trump vs. Slaughter, and that's because Donald Trump fired Rebecca Slaughter, who was a commissioner at the Federal Trade Commission. The Federal Trade Commission oversees things like mergers and acquisitions and antitrust policy. Basically, Trump didn't like that the FTC had become kind of anti-big business, and so he fired Ms. Slaughter and one other person, and then they sued, saying that her firing was illegal. Initially, a lower court agreed, but then it was overturned, and now it's in the Supreme Court. It seems like the justices, particularly John Roberts, who is the Supreme Court's chief justice, is inclined to agree with Donald Trump, and it brings into question a couple of things. The first one is, is there such a thing as an independent agency? Can something be quasi-judicial, quasi-legislative? Because, if you look clearly in the Constitution, there's no fourth branch of government. It also brings into question this concept of the expert culture, which Katonji Brown Jackson brought into the discussion. There's this presupposition that our government should be run by so-called experts, but it turns out that the experts tend to be mostly Democrats and a class of people that the broad populace generally has little faith in.
