We are tied to this right now,my fiancé filed the k1 for me,n now her ex is using common law marriage against her even though they were never married,now his attorney has reach out to my fiancé,my fiancé dont want to sign any divorce papers cause they were never married n she’s soooo confused what to do ,if she sign the divorce papers n put in the DS 160 ,does that create red flag????

But uscis themselves said they recognize common law marriage as long as your state recognizes it. We even got a document from court.
