Our legal system needs to break the habit of treating Donald Trump's executive branch as if it were honest and working in good faith. To understand why, let’s explore the remarkably thin pretexts for some of President Trump’s “emergency” declarations. 1) He declared that the Tren de Aragua gang was invading the U.S. on behalf of the Venezuelan government, and claimed that that gave him the power to summarily send immigrants to potential life sentences in brutal third-world prisons. Even before his proclamation, however, his own intelligence agencies had said Tren de Aragua was not invading and was not working for the Venezuelan regime. 2) He brushed aside permitting rules for oil and gas projects by declaring a national energy emergency. The U.S. has been producing record amounts of oil, and since 2019 we have been producing more energy than we consume. 3) He declared a trade “emergency” and said it gave him the power to personally set whatever tariffs he chose on any of our trading partners. But the U.S. has had persistent trade deficits since the Reagan Administration, and Trump imposed his “emergency” tariffs on some countries with which we have a trade surplus, plus several islands inhabited only by penguins. 4) He declared an emergency at the Southern border even though migrant traffic there has shrunk to the lowest levels in history. Part of the claimed “emergency,” Trump says, is immigrant crime. But in fact, undocumented immigrants are less than half as likely as native-born Americans to be arrested for a crime. 5) He declared an emergency at our northern border concerning the smuggling of fentanyl, even though less than one percent of the fentanyl entering the U.S. crosses the Canadian border. The U.S. sends more fentanyl to Canada than vice-versa. Even fake emergencies, unfortunately, enable Trump to grab real power. That’s a dangerous after-effect of generations during which we could count on our presidents to respect laws and norms. Having seen Trump’s abuses in action, courts, legislatures and voters should react accordingly.
