8awg on a 60 amp breaker would have been the correct install.

Wire only needs to be sufficient for the minimum circuit amps. Wire to the minimum, breaker to the max. You'll end up with 8 gauge wire on a 60 and that's totally fine.

so min circuit says 34 amps then max circuit says 60 amp 50 amp installed. yet HVAC guy thinks a 50 amp is no good for that installation... a 40 amp / 50 amp / 60 amp all okay to use.

shouldn't be a breaker outside, should only be a disconnect

60 amp is "max" but the 50 amp is adequate and sufficient.

just curious the maximum ocpd is 60, doesn't mean it needs a 60 Amp ocpd

Capacitor. If it’s not the capacitor, replace the entire system, including the ductwork. You also need to install a hepa filter and a UV light.

The wire does absolutely not have to be sized to the breaker! Just the minimum ampacity. Which is 34.7=8awg.

Then what’s the point of having one outside breaker and one inside and the one outside has the chance of overheating

minimum circuit ampacity is for the ampacity or capacity of the wire / wire size. RLA (running load amperage) is the max the unit should be running at.

First, let the system run for 10 minutes. If the breaker becomes extremely warm (100-120 degrees) replace it.
