I think the difference is premeditation. I empathize with the brothers and want them to be free now, but the planning beforehand is the difference between 1 and 2.

the difference is the jury .. ive come to realize that people who are picked to be in a jury really don't know what they are doing and that their choices affect people in many different ways

I think what’s tough is that’s there’s lot of evidence the brothers were planning for at a least a week. Where as your grandmother could more easily claim she snapped in the moment.
