Here's what’s happening, why it matters, and what it means for developers and the freedom to transact. ⚖️Roman Storm is facing decades in prison. The DOJ for the SDNY accuses him of helping launder over $1B in crypto, aiding North Korean hackers, and running an unlicensed money transmitter "business." The government ulitmately backed down from allegations that the mere use of computer code by others constitutes a violation of the unlicensed money transmitter statute--but only after a FinCen memo to DOJ was revealed confirming that a non-custodial protocol like Tornado Cash likely isn’t an MSB (Money Services Business) subject to prosecution under the unlicensed money transmitter criminal code. ⚖️Tornado Cash is an Ethereum-based privacy tool that lets users "mix" transactions to obscure their origin—like a VPN for money. It launched in 2019 and became a go-to for privacy, but also for bad actors. 🌪️ ⚖️The government says Storm had "control" over Tornado Cash and ignored warnings it was used in hacks (like the $455M Ronin attack). They say he updated the app’s UI and profited from rising TORN token prices. 💰 ⚖️Storm’s defense: He never controlled users’ funds. Tornado was non-custodial, decentralized, and immutable. You can't jail someone just because bad people used their code. He argues that code is not a crime. 👨‍💻 ⚖️The case is raising red flags. Witnesses are scared. It was reported that one witness plans to invoke the 5th rather than risk his testimony being used against him in a possible future criminal investigation. ⚖️Another potential witness--an investor in the privacy tech--initially alleged that prosecutors threatened him with prosecution if he testified for Storm. Dragonfly partner Haseeb Qureshi stated that the U.S. Department of Justice (DOJ) clarified it is not targeting Dragonfly or its executives in the Tornado Cash case, contradicting earlier media reports.
