As i understand it, it's only the use of "scotch" whisky that's protected, anyone can make whisky just not Scotch whisky, the Scots actually taught the Japanese how to make whisky. We shouldn't need to be so precious about the whisky spelling, it's only the Scotch bit that we really have protection for, I think?

Whisky with an e is American or Irish whisky with no e is Scottish or Japanese… the spelling depends upon where it comes from
