Here’s How to Get Your Green Card! 🇺🇸🇬🇧 Brad Bernstein explains the two ways a UK citizen married to a U.S. citizen can get their green card: 📌 Option 1: Immigrant Visa (Consular Processing) ✅ Your U.S. citizen spouse files an I-130 petition. ✅ You stay in the UK and wait ~18 months (approximately) for approval. ✅ Once approved, you get an immigrant visa at the U.S. Embassy in London. ✅ Enter the U.S. as a lawful permanent resident (green card holder). 📌 Option 2: Enter the U.S. on ESTA & Adjust Status ✅ Travel to the U.S. on ESTA (visa waiver program). ✅ Overstay for more than 90 days (yes, it sounds odd, but that’s the proper legal process). ✅ After 90 days, file for adjustment of status (green card). ✅ If you file too soon (within 90 days), you risk denial for misrepresentation. ✅ Even with an ESTA overstay, you’re eligible to adjust as long as it’s a bona fide marriage. 🚨 Important: Option 2 can carry risks, so consult with an attorney before deciding! My exact case,am a US citizen,hubby a British. citizen,came in with ESTA,but he never overstayed though,he leaves the country every 90days for a week or two and then return just to be on the safe side of things.We got married two weeks ago and we want to know if he has to leave?
