@kylaleelawyer: Replying to @Gallow_X a lot of people think that not consuming alcohol makes you immune to an impaired driving charge, but for people with disabilities or breathing problems who aren’t able to provide a sample they could end up facing a DUI, even though they’re completely innocent. And then your thrust into the position of having to prove your innocence
Thank you for replying & delving into my question. Very much appreciated. Thank goodness for folks like you who stand up for us. Best of the bestest wishes. Take care

It's really not a "rare case" when 71,602 people annually are charged with DUI, and failure to comply clocks in at about 106 cases.

There is NOTHING in the training manual about how to deal with people who are incapable due to a medical issue.

Government needs to provide a police recognized medical note on the DL for this purpose. Dr does the form icbc puts it on your licence. Won’t help out of prov ppl though.

canadian law is extremely flawed maybe there should be a card or something that you can provide to pruve that breathing issue as people can abuse it

so...if you can't blow enough to provide a valid breath sample, your car gets towed immediately, and stored. what happens to all the tow fees and storage fees even if you win??

Had a cop once that wouldn’t hold the breathalyzer still. Kept wiggling it n jerking it. Took two tries. figured he was intentionally trying to make me fail.

A medical document that is easily recognizable as being legit could be issued and presented to the officer. If it’s not a legitimate document then just add in that charge to the refusal to blow.

My favorite is when someone can speak in 17 word sentences, 15 more words than someone who is in actually respiratory distress, then all of a sudden can’t blow for 3 secs. It’s kinda obvious.

if sugar levels can be dected with a pin prick on the finger, then read by a small device, why can't the same be done for alcohol, at last as an option to blowing?
