The man accused of murdering conservative activist Charlie Kirk joined his court hearing in Utah today (Monday, September 29) remotely from jail. He called in via phone and did not appear on video. Judge Tony Graf in Utah's 4th Judicial District is presiding over the case of Tyler James Robinson, who is accused of murdering conservative activist Charlie Kirk while he was speaking at Utah Valley University. Graf appointed three attorneys - Kathy Nester, Richard Novak and Michael Burt - to represent Robinson (you can watch them enter their appearances here @Meghann Cuniff) and scheduled Robinson's next court appearance for Oct. 30. The attorneys want more time to review large amounts of digital discovery before Graf holds a preliminary hearing to determine if enough probable cause exists to support the seven charges against Robinson, which include a capital murder charge that makes him eligible for the death penalty. The judge spoke about his role in the case and how he'll operate moving forward. "As this case moves forward, Mr. Robinson's constitutional rights will be protected at every stage. He sits before this court presumed innocent, and that presumption remains unless and until each element of every offense charged against him is proved beyond a reasonable doubt," Graf said. "At the same time, and as applicable, victims are entitled under our constitution to be treated with fairness, respect and dignity, free from harassment or abuse. Justice demands that both of these principles, the rights of the accused and the rights of victims, be honored without compromise." Graf is a rookie judge in Utah’s Fourth District, which serves Juab, Millard, Utah and Wasatch counties. Utah Gov. Spencer Cox appointed him to the bench in May 2025. Graf acknowledged his inexperience today by noting he took an oath "56 days ago to support and defend the constitutions of the United States and of Utah." "I will carry out my duties with fidelity, transparency and impartiality, treating every person who appears before me with the dignity and respect they inherently do because they are human beings. Let me be clear, I will not put my finger on the scale of justice," Graf said. "These proceedings will be open to the public, conducted in accordance with the law and handled with diligence and competence to ensure that justice is never compromised. It is the standing order of this court that Mr. Robinson shall be allowed to appear in person so he can fully engage with his attorneys and participate in these legal proceedings.” "Counsel, regardless of who is watching, whether it is the nation or a single individual, we must fulfill our roles with integrity, civility and diligence. I encourage each of you to give your very best to this case. Neither Mr. Robinson or the people of Utah deserve anything less than the fair and impartial administration of justice,” the judge continued. Chad Grunander, chief of Utah County's criminal division, echoed Graf's statements. "In like manner, we commit to approach this case with integrity, with professionalism and civility. We are truth seekers. We will aggressively pursue the truth in this case," Grunander said. Before he became a judge, Graf was a deputy district attorney in Davis County. He also led the Utah County Attorney’s Office’s Special Victims Unit and was a deputy district attorney in Salt Lake County. Additionally, he has experience as an assistant attorney general in American Samoa, a deputy district attorney in Lincoln County, Nevada; and a special assistant U.S. attorney in Washington, D.C.
