That isn't lying, that's testifying. The question was whether the window was open when he approached the car. He didn't recall. If closed, it would have trapped odors making the smell more pungent, is all. Of course the window was opened at some point.

well I am not an attorney but he said I don't remember if the windows were up or down but if I was an officer I would remember weather I had to bang on the window to talk with the driver

Prosecutor here. In my 4th or 5th trial 20 years ago, the officer said "I don't recall, counselor" to the defense atty about 30 times. Quick not guilty. I was like wth?!

There's mostly good cops, decent people that want to make things better. Then there's the embalanced ones; they become cops because it allows them to bully and harass people. There needs to be more stringent psyche evals before hiring.
