The two, who appeared before High Court Judge Philanda Christiaan, denied all guilt and put the onus upon the state to prove the allegations levelled against them, save for what is said in pre-trial memorandums. The state is alleging that the couple murdered Silombela (41) in his house in the Eros area of Windhoek on 24 May, robbed him by stealing items including a television, and also stole his Mercedes-Benz car. They face charges of murder, robbery with aggravating circumstances, and obstructing the course of justice or an attempt thereof. On count one, murder, State Prosecutor Anna Amukugo contended that the accused, during the period of 23–24 May 2022, unlawfully and intentionally killed Silombela. In terms of count two, robbery with aggravating circumstances, the accused unlawfully assaulted Silombela by tying the deceased up, gagging him, and/or strangling him, and/or hitting him with blunt objects on his body and head, and thereafter taking the deceased’s property such as his silver Mercedes, a Huawei phone, a Sansui TV and remote, and several Standard Bank cards along with a PIN written on a piece of paper. The State Prosecutor, with regard to obstructing the course of justice, said that the accused unlawfully and with the intention to obstruct the course of justice, covered the deceased’s body with a blanket or duvet, locked his body inside his residence, and took his house keys and remote control. Further to this, the two are accused of abandoning the deceased’s motor vehicle in a bushy area in Okahandja to frustrate investigations. Representing both of the accused, Mbanga Siyomunji argued that both the accused contend that they had met the deceased on 23 May at a friend’s place in Soweto, Windhoek, and that the deceased had asked them for a place where he could buy drugs. It was after this that accused one, Kaapama, allegedly said he knew a place in Golgotha and drove the deceased’s car. Siyomunji said that after consuming the drugs, the three — Kaapama, Bezuidenhout, and the deceased — allegedly drove back to Soweto, and that thereafter the deceased had dropped the couple at Hakahana Service Station, after which they claim they never saw the deceased again. This, he said, is the reason for the presence of DNA evidence of the accused in the deceased’s car. Siyomunji further said that the accused would put this version to all state witnesses and also put it to the court that a cellphone retrieved from Kaapama’s father, which had been speculated to be the one stolen from the deceased, is not the same make and is an entirely different device. He also said that the accused dispute that they had disposed of the deceased’s car in Okahandja.
