@bradbernsteinlaw: Replying to @AoifeniL5 Title: Why Your Child Might Not Be a U.S. Citizen—Even If You Are 🇺🇸👶📜 Brad Bernstein explains a little-known rule: Just because you’re a U.S. citizen doesn’t mean your child born abroad automatically is too. 📌 Here’s what the law says: To pass on U.S. citizenship to a child born abroad, you must have: ✅ Lived in the U.S. for 5 years before the child’s birth ✅ 2 of those years after age 14 ✅ Been a U.S. citizen at the time of the child’s birth ❌ If you don’t meet those rules—your child is not automatically a U.S. citizen. 📌 So what do you do? 1️⃣ File an I-130 visa petition for your child 2️⃣ Have your child enter the U.S. on an immigrant visa 3️⃣ Once living in your physical and legal custody, if your child is under 18, they can derive citizenship automatically through you 📌 Bottom Line: Being a citizen isn’t always enough. If your child was born abroad, make sure you meet the requirements—or take the right legal steps to fix it. Got questions? 5 consecutive years? My daughter lives in Europe and this is really bothering me. She was born in the US and moved to Europe as an adult. If she has a child in Europe will her child be a US citizen?

Just because you’re a U.S. citizen doesn’t mean your child automatically is—especially if they were born abroad. Know the law, and take the right steps to protect their future.

What if they are born in another country that doesn’t have birthright citizenship? Would they be stateless?

if you are a us citizen but do not have the 5 year physical presence requirement and your child was born abroad you can not claim citizenship for your child unless you can prove that you have lived in the USA for 5 years, but if one of your parents is a US citizen and have lived in the USA for at least 5 years they can grandfather the citizenship to your child, you have to file for N600K

you can use your parents tax records if they claimed you as a child, that will count as physical presence. so does military time overseas

Even if you’re a U.S. citizen, your child born abroad doesn’t automatically get citizenship. You need to have lived physically in the U.S. for at least 5 years 2 of those after age 14. That’s why things like high school transcripts, work history, or lease records in the U.S. matter. You have to prove actual presence, not just hold a passport.
