A part you left out was that a large part of British India provinces didn't have a say on what country to be a part. It was decided by a British lawyer, Cyril Radcliffe, with no previous knowledge of the cultures and split them somewhat on religious ideologies in a very messy way. The original mistake. Kashmir( A Princely state) is and was a Moslem majority territory but led by a Hindu Maharaja. The Maharaja initially wanted to be independent and when that was unachievable, he tilted towards India.

Check your history again. All were given a choice to join Pakistan or India. As Kashmir was mostly populated by Muslims, they chose to be with Pakistan but the Hindu Raja who was ruling Kashmir decided otherwise. That is the start of the conflict
