For people asking about the “trafficking side of the case,” it’s simple! When y’all think about smex trafficking, there is only one thing that comes to y’all’s minds: y’all picture women being taken against their will and sold. But under federal law, if you use force, coercion, or manipulation to get someone to participate in sexual acts with you, that is considered smex trafficking because if you were using any of those tactics to get somebody to agree to participate, then that is considered to be non-consensual. I’m actually concerned about the fact that this needs to be explained, but I see so many people saying, “Oh, she was a willing participant,” “She agreed to do this.” But here’s the thing about consent: if that person is under any form of psychological control or abuse, then the consent is NULL and VOID. It doesn’t count, not just morally—LEGALLY. If you’re intimidating them in any sort of way, using scare tactics, threatening them, using any manipulation tactics to get this person to say yes, it does not count. Anything that transpires is still considered non-consensual. This is why DIDDY is BEING charged with SMEX trafficking.
