Habeas corpus is a legal principal that stop the wrongful imprisonment or ilegal imprisonment of a individual. However the detention of ilegal immigration who is suspected of invasion, terrorism or crime is a national security law and the law is different. National security have the right to detain and do investigation and do not share what they are doing. When someone over stayed their visa they have been already written their rights and consequences.
