Clearly that intersection needs to be re-engineered to prevent unwanted intrusion of cars in a bike lane. But the city will never do anything about it, cause that's infrastructure, and our governments are allergic to helping infrastructure. 😅

assumption of risk does not over-ride the law. failing to stop at the prescribed stop point is illegal. passing on the right in a bike lane is illegal. failing to yield to a bicyclist or pedestrian in their designated areas IS ILLEGAL

That's right in front of my house. You are legally allowed to swerve into the bike lane here, that's why it's dashed. It's done very common and the cars should have yielded but during really busy times you can have a dozen car using the bike lane to pass there

It’s a shared lane. No longer a dedicated bike lane, hence the dotted line. The biker was behind the bmw and could reasonably anticipate the bmw merging in. Being that they are behind the bmw, have the much clearer view of the scene, should have yielded instead of intentionally forcing their way forward into greater risk. What’s the road signs say, “share the road”. Very much applies to bikers.
