Let’s break this down: 📉 You “quitclaim” your house. 📉 You sign over vehicles and valuables. 📉 You assign a promissory note to the trust. 📉 And boom — you think your assets are protected and future withdrawals are tax-free? Not so fast. ❌ If the trust never actually pays you for the assets, it’s not a legitimate sale. ❌ If you still benefit from the assets, it’s not a completed gift. ❌ If you control the trust and remain the beneficiary, it’s not real asset separation. And here’s the danger: 🔹 Creditors can pierce through it. 🔹 Judges can void it under fraudulent conveyance rules. 🔹 The IRS can reclassify the structure and impose taxes, penalties, or worse.
