Well, if it’s up to the judge, we know what the answer is

so did the commonwealth rest? and did the defense ask for a dismissal?

Regardless of assuming Bev won’t grant it, does the defense have an obligation to file the motion?

I’m just going out on a limb here. And we know what Bev is gonna say. But the argument is they didn’t meet their burden. The best proof is seeing last trial that there was no conviction

Say she did dismiss. Could Karen be brought to trial again or would that end this?

I would not file, she will deny it and may influence the jury —

I really hope they don’t try to get it dismissed. Karen needs to win so she can sue and move on with her life.

If they do that, and she dismisses, does that mean they can retry her again?

Even if aunt Bev rejects it, would simply filing such a motion of dismissal (or whatever it’s called) help with a future appeal?

Bev will just say “well I feel that the CW has shown beyond a reasonable doubt “

I think this case should be one that didn’t meet the burden of proof but judge Bev definitely won’t dismiss it

But there’s no way the judge would ever go for this

It’s so interesting that they decided to call so few witnesses this time because I think the jury said they were confused by all the witnesses last time (in prosecutions favor)

Does a judge take previous trials in their decision? Or is it based only on the current case? Because they have impeached several witnesses & shown others not reliable better in this trial I feel.

Didn’t Alec Murdaugh do this before they put on their case?? I may be wrong but I vaguely remember this happening.
