Also depends on what is said, if it’s bodies hidden in the woods vs I once stole a candy bar when I was 8. 🤪 Context matters. But, does someone else have presumed privacy in my house. They willingly accepted the possibility of being recorded upon entering my home.

Im not sure how to ask this without sounding like an A-hole. This is a true genuine question. How then can the women who secretly record their abusive husbands inside their homes (and even bedrooms) get to use those recording in court to prove abuse? Shouldn’t the defense attorney argue it’s privledged under the right to privacy?

if the roommate knew the ring camera was out there, I feel there would be an argument for implied consent since he knows it records and is okay with that.

The one party consent law takes away the privacy requirement since you’re a party and there isn’t an expectation of privacy from a party to the conversation. This has been ruled on in court.

Wouldnt the specific location of the camera be paramount in establishing an expectation of privacy? It was my understanding that because they are roommates, common area that they share dont carry the same threshhold for expectation of privacy since it is a shared area. So if the conversation occurred in the bedroom where he has a full expectation of privacy from his roommate, but the camera is in a common area and records the audio, wouldnt that allow the recording since it was heard/recorded from a shared area?

What if both parties are aware of the ring camera? Like say it was in the living room and, since both parties are aware of the camera, there wouldn’t be an expectation of privacy, right?

I mean if he’s a former roommate wouldn’t he have been aware of the existence of the ring camera recording things occasionally and would then have given overall consent for the camera to record him regardless?
