I think 3rd party is more than implied here and I don't think the jury needs an instruction that gives them what is essentially permission, to consider it.

Defense doesn’t want them to have to pin it on someone— just wants to make sure that they don’t pin it on KR. There is more inference by the negligent handling & manipulation of evidence

IMO: it narrows the focus. Jury only has to rule out Karen. Don’t bother with who else did it then? Just decide; Karen is not the one who did this.

That all may be true if u didnt have a defense attorney explain in his opening arguments that he was going to put forth evidence of Brian Albert and Brian Higgins being the culprits. And that he could prove, with a witness mind you, that John went into the house. Hard to now claim Bowden when even the defense couldn't find evidence that he even went into the house.

Perhaps the defense wishes to set up the hypothesis of 3rd party slowly and when enough witnesses lead their testimony towards a third party and enough doubt of Karen then add 3rd party consideration
