I can’t imagine them lifting given precedents and the unconstitutional approach. They also start their hearing the 13th with Illston so why would at the SCOTUS level not side with the lower courts. My opinion which isn’t an expert one is that The Supreme Court is likely to favor leaving the injunction in place to prevent immediate, potentially irreversible harm to workers while the full legal challenge is sorted out. This approach respects the status quo, protects employees from immediate harm, and allows the judicial process to finish reviewing the case on its merits. The administration’s case is likely to argue that it faces significant costs and operational challenges by having the RIF blocked. However, from the court’s perspective, that usually doesn’t meet the irreversible harm threshold—especially compared to the immediate loss of pay and benefits that employees would suffer from layoffs. Hopefully 🙏🏾 prayers that it will remain in place and we get a 5-4 I.
