If the title is valid and vehicle registered then the state will deem it a legal sale. Especially if the vin comes back to the exact vehicle

My question would be, why can't the new buyer not knowing it was bought by fraudulent means sues the original seller for negligence for doing the due diligence to checking to see if the check is fraudulent?

they said they got the vin checked and it was not reported stolen. so in the end he made sure that it's legit. but the dealership was too slow to report it.
if it's stolen from an individual, sure it has to go to the original owner without costs for him, but from a business it should be that if they are too slow than that's their problem and the guys should be alliwed to keep it.

Wouldn’t be a Bona fide purchaser for value at that point. Unless they had notice it stolen, shouldn’t they be good and under no obligation to give back the vehicle? Or does GA law has a specific law that ignores/changes the BFP rules?

If I remember right, sometimes you can claim recourse from who sold it to you, and they can they claim recourse from the ‘stealer’.

We had this happen with a four wheeler at our dealership in Tennessee. Technically the insurance company owns it because we filed a claim on it and they paid us for it. If it was to be recovered, it would go to them.

This was a terrible argument in my opinion, the title could be real, if the original person paid the full amount with the check the dealership would give him a Title right away so he owned it outright and so do they, there’s nothing about a fake title
