Yes it would be slight negligence, however, the MAIN negligence is not following laws governing pool safety. Gates are mandatory, for a damn good reason. Children and water safety is no joke. Yes they put a safety measure in place, but this was chosen based on aesthetics. Chose the option that is safest for your children, not what makes your backyard look the prettiest. It’s not the husbands fault, it’s the parents fault - collectively.
