Arby is the legal father. A birth certificate is a legal document; therefore you cannot remove the legal father’s name from a birth certificate without a court order. Anthony and Arby must take a court-ordered paternity test before the judge will remove Arby’s name. I’ve seen in some cases that the judge will not allow you to remove the legal father’s name even once the biological father is identified. Every state is different.
