Remember, the questioned I posed was whether all undocumented people are criminals. My answer is no. Many came to this country legally and overstayed a visa, for example. Did many others break the law when coming here? Also yes. (2 things can be true at once!)
I don’t see this as a political issue. I think we need a common sense solution where we 1) deport undocumented people who are dangerous, 2) allow a path to citizenship for others, especially those who were brought here by family as children, and 3) help stabilize other countries—politically and economically—so their citizens will be less likely to need to leave their homeland and come here by any means necessary.

I agree with you; however, I feel that you should not ignore 8 U.S. Code § 1325. If you enter illegally, it is a criminal offense; whereas, if you overstay your visa, it is a civil violation

It is a crime to cross the border illegally, but statute of limitations is limited to 5 years meaning most people are no longer criminals and are actually breaking a civil infraction. hope this helps!

Over staying a legal entry is a civil penalty. Entering the country illegally is ALWAYS a federal crime. Those born here after their parents entered illegally I dunno.

And if you overstay your 180 days in Mexico they will deport you. The US should be working with these people to make it easier and possible to stay but we can’t just not know who is here. And US is always one extreme to another.

Not all undocumented people are criminals. Crossing the border illegally is a crime, misdemeanor. Overstaying your visa for example is a civil offense.
