@bradbernsteinlaw: Thinking about giving birth in the U.S. on a visitor visa? Here’s the deal: ❌ Coming on a B1/B2 visa just to give birth? Not allowed. ✅ Coming for medical treatment (with proof, like pre-scheduled doctor’s appointments) and giving birth while here? Valid, as long as you cover all costs. 🚨 If the government ends up paying for any part of your care, your visa renewal could be denied. Opinion my wife was pregnant when visiting US and the officer asked her if she was pregnant and she admitted she was pregnant and the officer told her to stay in US to have her baby, he may was playing some psychological tests on her but that’s what he told her..

Babies don’t work to a timetable. Sometimes they come early, sometimes late.

Can you please clarify if consular processing and interviews are currently happening for I-730 petitions filed by asylees (Visa 92) compared to refugees (Visa 93)? Especially for beneficiaries from banned countries — are interviews being held or completely on hold?

US birth tourism seems to be a business for people who have options and money in their own countries. People who are truly desperate and would do anything to get into the US won’t qualify for visas to begin with, let alone afford to pay for medical treatment in the US.

What happens after getting married and your hubby goes back to United States and you discover you got pregnant, what type of visa will he file for you? And does it require him coming back again to conduct a DNA test for the child to ensure and prove to the embassy that’s the biological child?
