In some circumstances you can get the insurance company on the hook (im unsure if this applies in NY but it does in CA) if they have bad faith and refuse to offer policy limits and take you to trial, they can be on the hook for the difference.

Unless the plaintiff offered to settle for policy limits and insurer refused, then they can busy the policy wide open and they may be on the hook for the excess amount too
