In some circumstances you can get the insurance company on the hook (im unsure if this applies in NY but it does in CA) if they have bad faith and refuse to offer policy limits and take you to trial, they can be on the hook for the difference.

If you had originally asked for policy limits and it goes to trial and you are awarded more than the limits, wouldn’t the insurance company be responsible for the difference?

Had a case recently where my client got out before trial on summary judgment. Plaintiff got a 13 million verdict as remaining defendants. Only 1 million in coverage. No assets.

How often does that realistically happen? Most people have a negative net worth or their only real asset is the equity on their home. Seems like a stretch that a judge is going to give someone someone else’s house?

Unless the plaintiff offered to settle for policy limits and insurer refused, then they can busy the policy wide open and they may be on the hook for the excess amount too
