Porsche is likely at fault as the Nordschleife Touristenfahrtenprogramm is considered a Toll road with no speed limit. You can drive fast, but it is automatically deemed reckless behavior and in case of any accident it's reckless endangerment. It is only punishable to go fast in Germany IF something happens. On the other hand, the Nordschleife follows the Rechtsfahrtgebot (slower vehicles must drive in the right side to clear the path for faster vehicles). He did move out if the path initially, only to re merge into the apex where the Porsche was overtaking. While this may he the BMW's fault, every victim of the accident must pay the damage themselves as it happened on a toll road where the driver of his own car is responsible for any damage caused by anything. Luckily, no one got seriously injured or died so this will probably settle quickly.

It was Porsche driver fault bdw shouldn’t overtake on the inner bend when it’s clearly obvs the bmw driver was going out to go in for a more stable quick turn
