Wewe endelea kukaa bed sitter na kizungu mingi without any wisdom. Have you thought of the consequences of burning state house? Do you think Ruto will suffer? He will probably fly to Europe and his family and continue enjoying his life. On the other hand, military will take over, suspend the constitution, many people will die, those rights you are talking about will end instantly or we become another Haiti.

I expected you to also articulate the Kelsenian theory of revolutionary legality, which suggests that a successful revolution can create a new legal order even when unconstitutional means are used to establish a new legal order!

You're misconstruing the "all sovereign power belongs to the people". In coup de'etats, for example, a small group can overpower a govt. Are such plotters still "the people"?

I agree to the extent that a government exists with the consent of the governed. However, according to John Locke's social contract, the people surrender some of their freedoms, retaining their natural rights; life, liberty and property in exchange for social order, security and protection. While the social contract can be used to explain the rationale behind paying of taxes, the idea that we pay taxes for the government to protect our natural rights is misleading.

Law student hapa unawork the problem backwards. The people reclaim their power through article 38,258,22,181,145,118,119,255-7 ... forcefully taking power is anarchy and treasonous for the conspirators

You are right only to the extent of the legality within the Constitution. Article 1 provides that the sovereign power shall be exercised only in accordance to the Constitution. Then refer to article 37 and have a wholesome reading of the same. The implementation and exercise of the provisions must be within the Constitution itself.

Uko sure wewe sio mjinga coz looks like you know too much that you don't want to know the rest or practical possible outcome of what you are calling for. Remember, those who drafted the constitution were not GenZ which means they were too learned than GenZ and saw things that GenZ haven't seen

Idealistically I agree with your position and Logic.Practically,it is not very ripe for Kenyans to carry it out.All revolutions from the French and Russian, there was a lot of suffering and discomfort from the citizen, even when you look at the Communist revolution in other countries, there had to be extreme suffering. As long as Kenyans have different pain threshold when it comes to this government,we only have one way out of it and which is not even guaranteed-2027.2027 will be the catalyst for the revolution you are talking about 😅 if the needs of the people are suppressed, then the pain threshold of Kenya will be the same for about a week and that’s a possibility of the revolution
