I am a claims adjuster for an insurance company and unfortunately the at fault party does not owe what is remaining on the loan only the value of the vehicle. That is why gap insurance exists. Sorry hun I know it sucks I have been there and learned the hard way to always get gap insurance

I just went through this. There was a wreck that was not my fault and totaled my 4Runner. We also did not have gap insurance, but Insurance did pay out for the four Runner for the Value is worth at the time. We still owed $1000 which we had to pay out-of-pocket to completely pay the car off. So your insurance should give you a check for the Kelley Blue Book value of the car at that time.

Yes unless they have no insurance, and sometimes you can file uninsured motorist call your car insurance company. They can find out if the other car has insurance it doesn't follow the driver it follows the car. Call right away they should also put you in a rental and yes if they have insurance they will pay off what you owe on it. But call the other persons insurance right away and keep on them don't wait. The police report will tell you what insurance company they had and you can call and file a claim if they haven't. I used to do claims.

So this happend with my sons mustang that we were paying on. it was his fault but when they totaled it out, they paid the car off and we got what was left out of it. his car had 15,000 left on it. and he had enough left to do a big down payment for a new car. I understand being upset, it will work out.

I know it’s not the most helpful, but when/if you can get some of it paid off, if you go through places some will help you with the negative equity of the car (what your paying for something you don’t have/can’t give anymore) I had to when I crashed mine last year because I was left with $6000 to pay. And needed a car to make money to pay anything so. Just a lil advice I’m sorry your going through this sweet girl 🥺

If you get a lawyer, you don’t have to pay upfront. They take it out of your settlement when I got into an accident. I didn’t have a lawyer at first I didn’t have no money, but I went there and they didn’t ask for no money until it’s settled and they took their half or whatever I owed them out of the settlement out of my settlement so it was paid for by the settlement.

Use your insurance and they will go after the other party for you. if you're not at fault it won't raise your rates!

that's what happened to my sister someone pulled out and hit her she still owed 10,000 of course the other driver wasn't licensed or insured so my sister has to pay. my sister was bruised for months. shes still paying on the car. now she has full coverage on her new car.

We are going through a similar situation. Except we lost our little boy. In a horrific fatal head-on collision. We are having to also pay for a brand new suburu. That was totaled on that fateful day. We had gap but it only fits in for a certain amount. We are paying $500.00 a month. We are probably going to loose our house over this whole situation. God bless!
