Contracting a the government is the best because their standard is literally we may terminate this at any time for any reason or for no reason and you have no remedy of recovery for anything bc congress might defund what pays for this at some point in the future

My favorite argument for why a consequence to a non-performance shouldn’t be there is “we would never do that” … okay then don’t do that and you won’t have that consequence, which is always followed by “but it’s a disproportionate consequence” and… so don’t do the thing you said you’d never do

At that point the contract just becomes a leverage point for remedies, often in arbitration, mediation, or litigation.

First thing i look at when evaluating a contract is, "Wht happens when something goes wong." The job of a contract lawyer is to plan for what happens when something goes wrong.
