@bradbernsteinlaw: The 3 Possible Futures of Birthright Citizenship in the U.S. 📝 With challenges to birthright citizenship looming, we’re staring down three possible outcomes: 1️⃣ The Supreme Court confirms the 14th Amendment guarantees citizenship to all born here. 2️⃣ The Court rules it doesn’t, and an executive order strips citizenship from children of undocumented parents—creating a stateless generation overnight. 3️⃣ Congress steps in with a middle ground: granting green cards at birth, not citizenship, to children of non-citizens. If they grow up here and stay here, they can naturalize at 21. If not, they lose status. 📢 : Comment which option you think is coming—and tag someone who needs to hear this. 🏷️ #BirthrightCitizenship #ImmigrationLaw #StatelessChildren #14thAmendment #TrumpImmigration #ImmigrationReform #CongressAction #KnowYourRights #TikTokLawyer #BradBernstein
Why would these children be stateless? The mother has the citizenship of her nation, that gets transferred to her child. If an American Mother gives birth overseas, that child is not stateless.

Wait but if a newborn has a greencard, but the parents get deported and the permanent resident needs to stay in the US to avoid loosing the greencard. Who can become the guardian of the permanent resident?

I don’t understand what u mean when u say they will be stateless? I was born in America to parents from Turks and Caicos and was given citizenship to Turks and Caicos immediately. The countries of the parents will grant them citizenship.

So let’s say an adult who was born here and has undocumented parents, would they lose their citizenship? If they rule with Trump

It's amazing to me how many commenters, while stating correctly that many countries don't have birthright citizenship, don't seem to be bothered that the administration has no plan to address the inevitable chaotic outcomes here. No plan on whether the children would have some kind of conditional status. No plan on whether state-to-state travel matters. No guidance on what sort of documentation would be issued. One of the excluded categories described in the EO includes that the mother be lawful but temporary, so this captures children whose parent is here legally. We live in a country where it took years to finally get RealID adopted, and we're barreling toward this deadline in a matter of weeks with no plan, and no concepts of a plan. Whatever your thoughts about birthright citizenship, it's undeniable that the administration is grossly incompetent. Expect chaos.

Why wouldn’t the country where the parents are from not give citizenship to the child? It’s like the USA has to give citizenship, but the home country of the parents has no responsibility?

Interesting. Even you are now pointing out that there are issues with the current law. Or should I say the current understanding of the law?

If the father is citizen and the mother processing her paperwork, the child will still get citizenship.

I voted for the guy but I don't think the Supreme Court will change 150 years of precedent, there has to be congressional action and im not sure Trump got enough support for this, at least not for now
