The problem is that the "standard of care" is often subjective in many situations. Medicine is part science part art. An "expert" can say that something did not meet the standard...but really..

Tom be on the lookout for a case involving the refusal of a doctor to treat pain with opioid meds, and suffering/or death ensued. It’s everywhere. We’ve swung too far. I believe it’s medical assault to withhold intentionally due to “opioid use disorder” aka addiction fear. Ridiculous.

I think it wouldn’t be considered frivolous if doctors weren’t being punished for making mistakes. It makes doctors practice defensive medicine which is a waste of resources. Patients should be compensated, but not from the people trying to help (unless doctor bills directly)

The ER didn't give adequate hydration to my 73y old dad when they ran 2CT, 2MRI in 4h span with contrast, they pushed me away from the ER 3x in 6h because I would advocate for him. it happened 3 months ago. 😭

Doctors never go against each other . They are so out of control that some doctors will involve themselves in another doctors problem and basically gang up on the patient. Something which is absolutely absurd for the rest of us . In other words , doctors bury their mistakes with Legal Backing

You can find an “expert” to say just about anything. Also, many suits (or threatened suits) settle not because they are valid but because it’s cheaper to settle than to defend at trial. Make the loser pay all attorney costs every time and maybe the system would become more fair overall.
