I wrote some crazy premised papers in college. I could see this as an assignment based on an argument on something controversial or taboo (or an opposition paper on your personal ideals) to learn how to properly use adverse opinions in future works. I'm curious about the original assignment. also, you have the free speech to write the paper... the university has the responsibility to uphold their code of conduct/ethics, which to me, this paper is blatantly encouraging discrimination. but that's just me.

I edited notes for YLJ, and let me tell you, I don't care what originalist knots you've twisted yourself in, if the argument of the paper is "America was racist at X time, therefore it's chill to be racist now," your argument is bad! If your conclusion is obviously wrong, it's much more likely there is *something* wrong with your premises or reasoning than that the obviously wrong conclusion is right.

I mean, the states that were forced to ratify could have just…not joined the Union, right? Does this mean that every peace treaty ever signed is also invalid if one of the countries involved had to sign said treaty in order to get the other guys to stop attacking them?

As a Leftist civil rights attorney, arguably specifically well-versed in the 14th Amendment, I'm thrilled about this paper. The student totally pulled the mask off both the Constitution and the Conservative legal movement. If I wrote the same thing but prefaced it, "What the Right believes is..." I would be ridiculed. I'm ecstatic that someone wrote this and that a FedSoc judge gave it an A+. I also think he's basically right and that all 3 of those constitutional Amendments were gutted, subverted by technicality, and never remotely enforced except by genuflection.

Imagine the 250 years of the USA as a movie and that after the movie was screened it received countless awards, is hailed for its complex story of internal growth and hard fought victories leading to the finale challenging whether the main character can overcome the challenges that remain within them. Does it make sense to rip the films awards away because a small group of people argue the film should have ended before it began because it can’t get any better than the intro scenes? That the world would be better off without the movie because there is no possible way its first 10 seconds could be topped? I think any rational person would say no.

Even without the later amendments, he would have to prove that zero non-white people existed in freedom at the time the constitution was written and were excluded from constitutional rights at citizenship at that time. And he would, in fact, be unable to do this. So his argument is nullified from the get-go even before you include later amendments.
