Tortoise are land, not aquatic. They get their water from the fruits and vegetables. Turtles are aquatic.

for all those who say tortoise do not go in water they actually do like to soak. She set them up perfectly shallow pond plenty of space to roam

It looks pretty good, but you may consider building a net cover over it, especially if you have hawks and/or crows in the area or you may have just built a smorgasbord
