It's so obviously broken and partisan at this point. I struggle to think about how we could restore legitimacy to the courts going forward and to deal with these obviously corrupt rulings in the future.

It's actually pretty simple. Student loans were a budgetary issue and Congress controls the budget. The Supreme Court let Trump go forward with staffing changes, which is the role of the executive department. Biden was trying to make massive budgetary changes. Trump is wanting to control hiring and firing in the department that's already under the executive branch.

Biden used the hero’s act which let the secretary modify rules about loans in an emergency. The court ruled that a full on forgiveness wasn’t a modification that congress agreed upon and was this a new program and thus illegal for a president to do without approval of congress. The gutting of the department is legal because he is not creating anything new nor spending anything new he’s simply not using the money already approved which is legal

Doesn't this mean that Democrats now have the exact, proven vehicle to pass SCOTUS muster if they want to push de facto debt relief? The next Dem POTUS can just refuse to fund the repayment apparatus and the people can keep them in office for as long as they want that benefit?

We need to pack the court. The court should have the same amount of judges for both parties.we don't have an independent court atm

I agree 100%; to give you context bc I know many who love this. They all said it’s an illegal department so you can tear it down without consent but that doesn’t mean ppl can not pay back money. There’s no logic nor consistency with them just outcomes they find justification for

what's neat is how are they going to collect on those loans? ik they put the loans in SBA, but i so sincerely doubt that they'll be able to produce documentation
