I had this happen. I successfully avoided getting hit by an 18 wheeler, but I smashed into the curb to do it and did about 3 grand of damage to my car in the process. insurance was like nope, get fkd. cool, next time I'll let myself get mangled by the 18 wheeler I guess

Let’s stop and watch again. This was the pov driver fault for over reacting. Did a car cut out in front of them? Yes. However there was a second lane pov car could have gone into. If I was the adjuster on this I’d say pov at fault. While you should do your best to avoid an accident in this case there were no adverse road conditions that could have caused the over correction

In the uk if u course an accident such as somone swirving to avoid collision and they have a crash you can be held liable especially in this instance

Insurance Adjuster here, been in the industry since 2013 and have worked for Geico and State Farm. Unfortunately, fraud is a major risk to us and happens far more often than people might think so we do need to verify the facts of the loss. If you have no evidence of a phantom vehicle then we can still handle the claim under your collision and PIP coverage instead of UMPD and UIM but it will be treated as a single vehicle at fault loss. I hate that it has to be like that but a lot of people gaming the system ruined it for everyone else. I also dont have any incentives for not paying out claims and getting yelled at isnt something I enjoy... I just have to go with what I can prove.

License plate is on the video which is easy to use to find the owner of the vehicle. As long as you file a police report, would that be enough?
