RAS is not the standard for an arrest though. Maybe you’re right but it’s the wrong terminology. The officer would need “probable cause” which is distinct from RAS

If you refuse roadside test. But willing to take a blood test or the more accurate breath test that is given at a hospital or the police station, is the roadside refusal be considered a refusal resulting in license suspension? Wow that was a long way to ask, but hopefully clear enough.

The ONLY reason cops do a FST is to gather evidence to use against you at your trial. If they're asking you to do a FST, you're already 100% going to be arrested. Don't assist them in getting more evidence to convict you.

Depends on whether you’d rather have your license suspended for a year or have a DWI conviction, though right? If you don’t do the FST, don’t take the breathalyzer, and have a decent lawyer, you’ve got a decent chance at getting an acquittal or dismissal bc it’s a lot harder for the state to meet their burden of proof. Not having a license for a year is a HIGH price to pay to take that chance though, and not everyone has the means to hire a good lawyer.

In every state I’ve lived in, your required to submit to a BAC test. Passing sfst’s can skip the trip to the station or a hospital refusing the test will guarantee the trip.

you should refuse the "walk in a line" and stuff tests, right? how does it help you at all? and there is no penalty for refusing those particular tests, right? You should definitely do the breath tests though.

Reasonable suspicion is subjective though. I’m assuming if he’s wrong one could sue correct? He would then need to prove he had “reasonable suspicion”?

might be different by state. refusing in Illinois was 3mo suspension like 10yr ago. I haven't had to worry about it for years though 😁

This reminded me of the time I drove back home after a show in a town an hour away. It was around midnight, i get pulled over (speed trap), cop asks me if I had been drinking. I say no, don’t find it necesssry to mention that I had had a single beer maybe 4 hours prior. At this point I’m totally sober. He asks to take a field sobriety test, I agree to it. I walk the line, pass it with flying colors. He asks me to take another sobriety test. I’m admittedly a little tired so I get the feeling that he’s hoping I fail a test eventually, drunk or not. I ask that he just breathalyze, he asks if I’m sure, I say yes absolutely. I blow zero. He slaps me with a speeding ticket lol

I sat on a jury one time. Guy was pulled over for suspected DUI. He refused a breathalyzer but did the FSTs. He was given the instruction to take ten steps on the line on the side of the road, turn around and come back. He took ten steps, and didn’t turn. He walked backwards the ten steps. He was arrested and they never got a definitive BAC. Since we had no proof there was any alcohol in his system and he did an arguable harder task, we voted not guilty.

So then refuse the field sobriety test but don’t refuse the fancy breathalyzer. I’ve seen so many police body cam vids, and I don’t think I’ve seen a single person get let go after performing a field sobriety test.
