Accountant here - we deal with the ATO all the time for our clients regarding super - the ATO are unrelenting with this (quite rightly) and at any sign of non-payment they’re on it immediately it’s why it’s important to report it to them.

The Australian government just changed the rules to stop this. They used to have to report and deposit your super every 3 months. Now it's every fortnight so it can be picked up sooner.

They don't get away with it. The ATO plays nicely to start with but then they ramp up the pressure up to full scale audit and court proceedings. The ato always wins

also make sure there paying your Medicare levy in your taxes or you will get a bill when you do your tax return

And ultimately the directors of the company become liable for unpaid super if the company is forced to wind up.

They bought in a new rule in July that they will get fined huge amounts and cant wait months. Some companies invest the money make money off it and pay every six months. They dont get away with it though.

My old employer didn’t pay $14k into my super, but we shared an account so when I told them, they lost it & made my old boss pay! Then for the next few years he was trash talking me to everyone he could saying that because he had to pay that it was like I was stealing money from his children & that he wanted me unalived! Crazy times!
