@kylaleelawyer: Replying to @grumpy trucker yes there are presumptions that favour the crown and impaired driving laws in Canada. But that doesn’t mean you’re guilty until proven innocent. It’s a little more nuanced than that.
There are no pre-requisites for a Demand.... you don't blow you go.... 99% of people can not afford 10-20 grand to fight

I refused to blow your honour because I have CPOD, but under the law you’re not allowed to ask for my medical files. Please would have to seek a warrant to get those, which I understand. It’s a pretty high burden for medical information.

My concern is that the police almost always give incorrect legal advice to people at the roadside in those circumstances and people rely on that information and then face the charge and facing the charge is punishment enough

just seems crazy it's illegal to refuse to provide evidence to the police that will be used against you, why not just make a law that anyone bans anyone from refusing to testify in court as well or refusing to answer police questions? forcing someone to blow isn't much different than forcing someone to speak and answer questions or face a criminal charge
