Mold earth has to be loose earth to excavate. (Like a recently dug grave as an example or recently buried treasure). There’s another issue too but this is the main one since the other can be house ruled.

unfortunately, mold earth specifies loose earth. Loose earth is anything that can be easily excavated with bare hands.

Doesn’t work. Mold earth can’t move normal packed dirt for this reason. Also current rules don’t allow action surge to cast a spell.

I love min/maxing builds and all, but it makes plenty of sense to me you can’t use action surge to cast a spell (even just a cantrip) and you now have to use bonus actions to smite. Go ahead and make a “broken” character. I’ll adjust CR accordingly.
