Seems like a pretty ousized reaction when I said I didn't think you were wrong, I thought how you explained it was confusing. I very specifically said it "seemed" like you were saying reasonable suspicion was enough for arrest and then immediately followed that with but no lawyer would make that mistake, so there's obviously a misunderstanding here. I stand by that. Maybe I should have said you used clunky phrasing instead of misspoke, but I never said you didn't know what you were talking about or that you were wrong about what standards applied to what actions. I've got the same JD you do.

I saw the original video. As a cop who’s mad God-knows how many DUI arrests, it seemed like you were just telling her the practical truth of it rather than giving a complex legal breakdown. Telling the person the information they needed instead of giving a full explanation they may get confused over. I had zero issue with it. Also, I’d like to add, bloodshot eyes and the odor of an alcoholic beverage alone is probable cause for a DUI arrest. The rest of the investigation is just observing more evidence to determine if the arrest would be a quality one or not. Either I’m documenting more reasons to prove DUI or I’m observing the person be mostly okay. I’ve let almost as many go after SFST and PBT showed they were a 0.03-0.06. Usually tried to get them a ride, but that ability to cooperate and regulate their emotions during the investigation is also a sign that they’re closer to sober than not.

you are correct and now in TN they are required to track DUI arrests of sober drivers because its been so bad. doesn't solve the problem but maybe there will be some accountability out of it.

In Canada you can be charged for refusal to provide a breath sample, any driver can be subject to a MAS demand (mandatory alcohol screening) with or without suspicion.

My business partner is an attorney of 20 plus years and my favorite thing I've heard them use has always been " please don't confuse your Google search for my law degree"
and he's right, I'm a DUI defense expert who gets paid to know, teach, and testify to this stuff.

If you are being asked to do FSTs, cop has already decided you are drunk. They don’t ask people who they think are sober to do FSTs.
