The state opposed bail for the nine accused in the N$480 million Namcor corruption case, citing risk of abscondment, possible evidence tampering, seriousness of the charges, public interest, and pending arrests of more suspects. State prosecutor Basson Lilungwe said the expanded and detailed charges are based on ongoing investigations and a review of over 18 files of evidence. “The charges initially when the accused persons appeared were not as detailed as they are now and in fact charges have been added up to count number 71. I have also indicated to my colleagues that for the purposes of the bail there are documents that we seek to rely on, which documents are contained at least at this stage it's about 18 files which we have to sift through me and my colleague throughout this weekend,” said Lilungwe. Lilungwe the documents were not disclosed to the council because they were busy drafting the charges. Meanwhile, defence lawyer Sisa Namandje argued that the State inflated the alleged N$480 million figure without evidence, accusing it of fuelling media-driven bias and making unjustified arrests of the accused.

"We will demonstrate that the state co-opted the media into their processes, maybe to provoke public anger...Something that the Supreme Court of Namibia and the High Court both have said the state has no business to use the media to harass accused persons during their arrest.
