nope. put it in a life estate. you still get the step up for taxes and all you have to file is the death certificate.

Yes you can before you die you take everything you own and you put it in their names it's now legally binding and it belongs to them any other assets that you have you write a letter have it notarized and placed in your county or your city records that is a legal document You can avoid all of this there are simple ways to do things but lawyers love the extra fees😂😂😂

They will inherit your cost base in that way but in a trust they will get the worth of the house as a cost base when you did so they can sell and not be strapped with the taxes on the home.

In Texas we have a Lady Bird Deed, which does not make them own anything or have any rights to the property, you can rent it, sell it or whatever because it’s still yours. When you die, the person you named on the Lady Bird Deed just takes an id and the death certificate and they transfer the title to their name, no probate.

they are going to lose the Step Up in bases under Section 1014 IRC and get hammered with capital gains income taxes. there's no need to co-own a property you want to leave to your children in order to avoid probate. you really need to stop giving legal and tax advice when you are qualified to give neither

Irrevocable trust 1. You're the Trustee while you're alive 2. Name a Succesor Trustee Who will take over the Trust when u die 3. List kids/Beneficiaries. after your death everything is to go to them avoids Probate 💪 You need to carefully word the Trust !!!! HIRE A LAWYER!

And before you die, creditors can put liens can if your kid gets in financial trouble. If you wanna give up your rights to your house that early an irrevocable trust is better.
