Speaker Mike Johnson (R-LA) on Tuesday asserted that the War Powers Act is unconstitutional as he defended President Trump’s decision to launch strikes against Iran. “The Framers of our Constitution never intended for the president to seek the approval of Congress every time he exercises his constitutional authority under Article II, as commander-in-chief,” the speaker said. The War Powers Act of 1973 requires the president to notify Congress with 48 hours of military action and limits the deployment of forces beyond 90 days without a formal declaration of war. It does not prevent the president from deploying the military in the case of self-defense or imminent threat. Lawmakers from both parties have sought to reassert Congress’s authority as the sole branch of government tasked with declaring war. Reps. Thomas Massie (R-KY) and Ro Khanna (D-CA) introduced a resolution last week to terminate the use of U.S. forces in Iran unless given explicit approval by Congress. Reps. Gregory Meeks (D-NY), Adam Smith (D-WA) and Jim Himes (D-CT) introduced a similar resolution on Monday following the strikes. The speaker had already rejected those efforts, but his comments Tuesday took it a step further, declaring the Nixon-era law unconstitutional. “Many respected constitutional experts argue that the War Powers Act is itself unconstitutional. I’m persuaded by that argument,” he told reporters in the Capitol. “They think it’s a violation of the Article II powers of the commander-in-chief. I think that’s right.” Speaker Johnson (R-LA) pointed to numerous instances over the decades in which a Democratic president had used military force without congressional sign-off. “The bottom line is the commander-in-chief is the president, the military reports to the president, and the person empowered to act on the nation’s behalf is the president,” he said. #speakerofthehouse #mikejohnson #cspan
