And not a single actual lawyer is surprised. Just embarrassed.

I use AI to write my motions, complaints and basically everything. What I also do is proofread and make sure all the case law/statues are real. This is crazy!

They shouldn’t be using ai AT ALL. No need to “get used to it”

In Georgia, a divorce case got decided, with a final judgment with fake case law! it had to be appealed. What were that judge’s clerks doing???

I worked for a govt regulatory agency and responding to AI-generated complaints with fake statutes or wildly incorrect statutes ate up so much time

A judge in NJ cited AI hallucinations in his order. He withdrew the order after it was pointed out. A JUDGE!

One recent AI issue I read about is kind of cannibalization—new AI scrapes of the Internet have ended up including error-filled AI-generated content in their haul, so mistakes are compounding. I’ve been shocked at the bogus AI results I’ve seen for very basic, simple content—I can only imagine what it’s doing with legal issues.

Needs to be an automatic suspension for a few months at least. Checking to see that the law exists is maybe 10 minutes if your internet is slow and the doc is about 5 pages.

I actually don’t think this is excusable even as new tech. They had something else write a document for them that they didn’t even bother to check. They didn’t verify to know what they were sending in or talking about. That seems like a dangerous precedent for most jobs, let alone an attorney

I saw an article on linkedin yesterday where Sam Altman was talking abt the lack of privilege associated with AI, so any AI queries for legal advice, etc. can be discovered later too 🥲

I feel like they are asking for AI to take their jobs like why rely on it when we truly don’t need to and it will only complicate an already complicated system

This seems like the modern version of when the college students I taught in 2008 would cite Wikipedia.

The problem is less AI and more most actual case law is hidden behind a paywall, especially after West Law’s most recent acquisition

I was a paralegal for 3yr. No offense but cite checking isn’t even a super labor intensive task. Especially just checking a case EXISTS😭

This is funny now, but there are MCP servers that allow LLMs to have grounding so they don’t cite hallucinated cases. In the future they’ll make errors but they’ll be far more difficult to detect.

What I don’t understand is how these attorneys aren’t just using Lexis Protege or whatever Westlaw’s equivalent is now. At least at the BARE minimum then you have drafts with real cases, even if the holdings are wrong.

As a lawyer i was taught to read every case i cite. As a partner i read every case cited by my associates. I read every case cited by my partners when im filing for them. I dont put my signature on any filing without doing due diligence.
