MICSEA: Doxing, Threats & Fear: HR's New Criminal Law Challenge During his keynote address at the HR & IR Summit 2025, Mr. YK Lai emphasized the far-reaching implications of the newly enforced Penal Code (Amendments) Act 2025, which came into effect on 11 July 2025. He highlighted that the introduction of Sections 507B to 507G marks a pivotal shift in how Malaysia treats misconduct related to threatening, insulting, or defamatory communications. Of particular concern to employers is the new offence of unauthorized distribution of personal information, or doxing, which is now punishable by up to three years in prison. Mr. Lai stressed that this development transforms workplace misconduct from a matter of internal policy into a matter of criminal liability. According to him, HR professionals and company leadership must now: ✅ Institutionalize workplace violence and harassment prevention protocols, ✅ Retrain managers on escalation procedures and early risk detection, and ✅ Integrate criminal risk management into company policies and SOPs.
