From experience when my sister passed away my niece had to go live with her dad for a while because he was the only parent. He had a prison record and was not in her life for 8 yrs. It took 2 yrs for the the judge to follow my sisters wishes/will. SMH

Get legal advice First in your State and His State to know what happens if one parent dies bc they are Different. It doesn’t matter if he never met her or supported her by Law they will give her to the other parent.

This isn’t bad advice and still probably won’t help. Doesn’t matter how long contact has been unless you terminate his rights. Accepting or requesting child support means he’s in her life not matter how little it is. If something happens to you he is her father and will go to him. There’s not a will that can prevent that. Even if he’s in another country. we very much uphold parental rights. There’s no grandparent rights or sibling rights so no matter what your will says she can end up in Mexico with her dad and I’m sure wife will go along once you’re not in the picture more easily. Ask me how I know. So no contact. No child support. Wait the appropriate time and terminate rights. Then you can express your wishes as to custody for your child even then it doesn’t have to be upheld. But likely it will go to whomever based on no one I.e. “dad” having a say so.

In most states none of this stuff will disqualify him from gaining custody if you pass away and he fights. Again, seek legal advice and specifically ask about termination of parental rights as to one parent only. If the statutes allow see if he will sign surrenders. That would give up his rights and responsibilities.

I’m sorry you appear offended, not my intention. My goal was to share what I learned when I experienced something similar. When my son died I had to fight for custody of my grandson and went to war with his biological mom who was absent. Timelines and documention is what helped me prevail.

Your best bet is to have him sign his rights away. Unfortunately none of what you have posted and said and to be honest there isn’t a lot that would completely keep her away from him. As wrong as all of it is and it’s common sense to us that he isn’t a fit parent but the courts unfortunately don’t see it that way
